                                                                           BUFFALO HUNT CLUB GUEST RELEASE AND WAIVER 

The undersigned person, as a guest or invitee of Buffalo Hunt Club or a member thereof, on his or her own behalf and on the behalf of his or her legal representatives, assigns, successors, attorneys, insurance carriers, heirs, affiliates, and agents (collectively the “Releasor”) hereby releases and discharges the Buffalo Hunt Club, Johnny Horton, Horton Ranch and all of the members, managers, employees, parents, subsidiaries, officers, directors, representatives, assigns, successors, attorneys, insurance carriers, heirs, affiliates, and agents of the Buffalo Hunt Club, Johnny Horton, and Horton Ranch (collectively the “Released Parties”) and forever holds the Released Parties harmless from any and all liability, claims or causes of action, demands or suits of any nature or kind that the Releasor or any guest or invitee of the Releasor (the Releasor and any guest(s) and invitee(s) of Releasor shall be collectively referred to herein as "Participant") has or may have against the Released Parties arising out of, or in any way connected with, any Participant's presence or participation in any activity on Horton Ranch or any property of Horton Ranch for any and all injuries to any Participant's person or property, damages, or losses, known or unknown, fixed or contingent, liquidated or unliquidated, whether or not asserted, caused by the negligence of the Released Parties or otherwise, that any Participant has or may have against the Released Parties. The Releasor hereby expressly agrees not to institute, maintain, or prosecute any of the claims, rights, liabilities, obligations, damages, costs, expenses, interest fees, attorneys' fees, and/or causes of action, of any kind, nature or description that are released herein against the Released Parties in any state court, federal court, administrative agency, arbitration proceeding, and/or any other court or tribunal whatsoever located in any jurisdiction. The Releasor further agrees to indemnify and hold harmless the Released Parties relating to any and all loss, liability, damage, or cost that the Released Parties may incur arising out of any Participant's presence or participation in any activity on Horton Ranch or any property of Horton Ranch. The Releasor affirms the Releasor is currently covered under  appropriate general liability and personal health insurance policies issued through a licensed insurance carrier, and is responsible to ensure that all Participants are so insured. The Releasor represents and warrants the each Participant's participation in any activity on Horton Ranch or any property of Horton Ranch does not violate any federal, state, and/or local laws and ordinances regulating such activity, if any, and each Participant has obtained any necessary permits or licenses to engage in such activity if required by law. The Releasor expressly acknowledges, agrees, and understands Horton Ranch and any property of Horton Ranch and any activities thereon all have and carry inherent risks and dangers and no amount of care, caution, instruction, or expertise can eliminate such risks and dangers. THE RELEASOR EXPRESSLY AND VOLUNTARILY ASSUMES ALL RISK OF AND RESPONSIBILITY FOR DEATH OR PERSONAL INJURY SUSTAINED BY ANY PARTICIPANT WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE. The Releasor further expressly agrees the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Texas and that if any portion thereof is held invalid, it is agreed that the balance shall, not withstanding, continue in full legal force. THE RELEASOR HAS READ AND VOLUNTARILY SIGNS THIS RELEASE AND WAIVER AND UNDERSTANDS THAT THE RELEASOR HAS GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAS SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO THE RELEASOR AND INTENDS THAT THE RELEASOR'S SIGNATURE IS A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE FULLEST EXTENT ALLOWED BY LAW.
